Terms and Conditions

Operated by Phyto Evolution Pvt. Ltd. (hereinafter “Company”)

By accessing, browsing or placing an order on foreststudio.in (“Website”), the user (“Buyer”/“Customer”) irrevocably agrees to be bound by these Terms & Conditions without limitation or qualification.

1. LEGAL ENTITY

The Website is owned and operated by Phyto Evolution Pvt. Ltd., a company incorporated under the laws of India with GST registration.

2. SCOPE OF SALE

The Website sells, inter alia:
orchids, carnivorous plants, other live horticultural material, horticultural accessories, lighting equipment, Phyto-chemicals, IoT devices, and B2B supply of related items, within India only.

3. PRICING, TAX & INVOICING

All prices are exclusive of GST. GST shall be charged separately.

A valid GST invoice shall be issued for every order by default.

Prices are subject to change without prior notice.

4. PAYMENTS & PRE-ORDERS

Only prepaid orders are accepted (UPI or bank transfer). No COD is permitted.

All advance/pre-order payments are strictly non-refundable irrespective of lead time or delay.

5. SHIPPING, DELIVERY & TRANSFER OF RISK

Risk and title in goods transfer to the Buyer only upon delivery as per the courier tracking log.

Claims for delivery damage or shortage shall be entertained only if:

a complete uncut opening video is provided, and

the claim is filed within 1 hour of the courier’s delivery timestamp.

Any claim not satisfying both conditions above is automatically rejected without exception.

6. CANCELLATION, RETURNS, REFUNDS

No cancellation is permitted after payment.

No return, replacement, refund or credit is provided for live or non-live goods, except where a claim is admissible under Clause 5.

Store credit in lieu of refund shall not be issued under any circumstances.

7. INTELLECTUAL PROPERTY & USE OF CONTENT

All images, text, plant data, technical protocols, product descriptions, design layouts and digital assets on the Website are the exclusive intellectual property of the Company.
Any reproduction, scraping, academic re-use, redistribution, or derivative use without prior written consent is strictly prohibited.

8. USE OF PERSONAL DATA

The Company may collect, process and retain user data for order fulfilment, record-keeping, analytics, and marketing.
Data may be shared with logistics partners, payment gateways, or third-party service providers as required for operations.

9. EXCLUSIONS & LIMITATION OF LIABILITY

The Company shall not be liable for:

consequential, indirect, special or incidental loss,

crop failure, contamination, or biological non-performance,

misuse, mishandling or misapplication of purchased goods by the Buyer.
The Company’s aggregate liability, if any, shall not exceed the invoice value of the disputed item.

10. COMPLIANCE & AGE

Use of the Website constitutes a legal declaration that the Buyer is competent to contract under Indian law.

11. JURISDICTION & GOVERNING LAW

These Terms shall be governed exclusively by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts at Chengalpattu, Chennai, Tamil Nadu only.

12. AMENDMENT

The Company reserves the unilateral right to amend these Terms at any time without notice. Continued use of the Website after modification constitutes acceptance of the revised Terms.
